In a recent court document, special prosecutors in New Mexico assert that actor Alec Baldwin’s actions on the “Rust” film set resulted in “safety comprises” that ultimately led to cinematographer Halyna Hutchins’s 2021 death.

In a filing on Friday, the prosecution presented their evidence in response to a motion filed in March by Baldwin’s team to have the actor’s charge dismissed.

According to a copy of the answer obtained by CNN, the prosecution claims Baldwin has frequently “changed his story” about what happened during the shooting and that he had “absolutely no control of his own emotions” on set.

Baldwin’s agent declined to provide a statement regarding the recent filing.

According to the document, Baldwin’s “relentless rushing of the crew on the movie set routinely compromised safety” during his early days on set when he insisted that the workers and the armorer, Hannah Gutierrez Reed, “work faster.”

Baldwin, according to the document, had “absolutely no concern for how his conduct” affected those around him. He was known to yell and swear at staff members, himself, and no one in particular on set. The petition claimed that “witnesses have testified that it was this exact conduct that contributed to safety compromises on set.”

Director Joel Souza was hurt and Hutchins died in the incident after a revolver owned by Baldwin went off during a scene rehearse on the western set. Baldwin entered a not guilty plea to the charge of involuntary manslaughter in January.

In March, Gutierrez Reed, who oversaw the storage and safety of firearms on the film’s production, was convicted guilty of involuntary manslaughter. She can be imprisoned for up to 18 months and fined $5,000.

In the petition, prosecutors further claim that other crew members saw Gutierrez Reed as “inexperienced and overwhelmed” on set, but Baldwin—who was also the film’s producer—had ignored this behavior.

According to the complaint, “Halyna Hutchins would meet her demise at the hands of Alec Baldwin’s utter disregard for the safety of those around him and Hannah Gutierrez’s carelessness and inexperience.”

Baldwin’s post-incident public remarks were also attacked by prosecutors, who claimed that the actor was trying to influence public opinion.

Baldwin’s legal team attacked the actor in their March filing, claiming that the prosecution had “publicly dragged Baldwin through the cesspool created by their improprieties—without any regard for the fact that serious criminal charges have been hanging over his head for two and a half years.” They also asked for the indictment to be dismissed.

His attorneys stated in the filing, “This is an abuse of the system, and an abuse of an innocent person whose rights have been trampled to the extreme.”
