Attorneys for Donald Trump and special counsel Jack Smith suggested delaying the trial in the case involving the former president’s secret documents until later in the summer.

Smith stated in court documents on Thursday that he thinks the July 8 trial for Trump and his two co-defendants, property staffer Carlos De Oliveira and political assistant Walt Nauta, is appropriate.

However, Trump’s legal team restated their belief that the former president cannot receive a fair trial before November’s election, citing in their filing specific political dates that the former president must attend in order to be on the campaign trail, such as the Republican National Convention. Even though the trial is scheduled for the summer, Trump may yet ask for postponement.

Although District Judge Aileen Cannon, who is presiding over the case, is anticipated to discuss the date in a hearing on Friday, the case is presently set for trial in May.

Following his indictment in June 2023, Trump is facing numerous accusations stemming from his alleged mishandling of sensitive documents. The first trial was scheduled to begin on March 4, but US District Judge Tanya Chutkan had already postponed it while appeals courts considered Trump’s allegations. The top court’s ruling could also have an impact on how the case involving the classified materials plays out.

The question of whether Fulton County District Attorney Fani Willis should be removed from office is at the center of Georgia’s state election subversion case against Trump and 14 of his allies. Some within the district attorney’s office believe that this action could potentially ruin the case as a whole, as CNN previously reported.
