TFD – New York’s highest court has declined to hear Donald Trump’s appeal over the gag order in his hush money case. This decision leaves Judge Juan Merchan’s gag order in place as Trump faces multiple charges of corporate fraud. Stay informed on this significant development in Trump’s legal battles.

According to a decision list released on Tuesday, the top court in New York has decided not to hear Donald Trump’s appeal over the gag order in his hush money case.

Judge Juan Merchan’s gag order, imposed in the criminal case against Trump, is still in place.

In addition, before his July sentence, Trump has requested Merchan to lift the gag order. In connection with payments of hush money to adult film star Stormy Daniels, the former president was found guilty on 34 charges of corporate fraud.

Todd Blanche, the attorney for Trump, remained silent.

Before the trial began in March, Merchan approved the prosecution’s request for a gag order, which barred Trump from speaking publicly about any of the case’s witnesses, jurors, prosecutors, court employees, or relatives. Trump was free to express his opinions about Manhattan District Attorney Alvin Bragg or the judge.

For breaking the gag order ten times during the trial, Merchan found Trump in criminal contempt, fined him $10,000, and threatened to put him in jail if he kept up the behavior.

According to court spokesperson Gary Spencer, Trump has 30 days to submit a move for permission to appeal, which is another way the court could decide to hear the matter. The court will decide once more whether to hear the case when that motion is submitted.

Trump’s legal team contended in a brief with the appeals court that the case raises “substantial constitutional questions of the highest importance.”

“This gag order violates the fundamental right of every American voter to hear from the leading candidate for President on matters of enormous public importance,” wrote President Trump’s attorneys. “It restricts President Trump’s core political speech on matters of central importance at the height of his Presidential campaign, where he is the leading candidate.”

Even though the trial is over, according to Trump’s attorneys, the case still raises important constitutional issues, and the gag order has no end date specified.

Trump’s counsel stated that the gag order would “undermine the justification” for the fines Trump was assessed for his infractions if the Court of Appeals decided that it was illegal.

Asserting that Trump has a “well-documented history of leveling threatening, inflammatory, and denigrating remarks against trial participants,” Bragg’s office asked the court to dismiss the appeal in their own brief.

Conclusion

The refusal to hear Donald Trump’s appeal on the gag order underscores the ongoing legal hurdles he faces. This decision reinforces the measures taken to ensure a fair trial and the protection of involved parties from potential inflammatory remarks. As Trump prepares for his July sentencing, the implications of this case on his public and political life remain significant. This development is a reminder of the complexities and high stakes involved in the legal proceedings against the former president. Stay updated as this story evolves.
