Following the January 2023 shooting that claimed seven lives, the family of a man who was killed in a mass shooting in Northern California and his brother, who was hurt in the incident, filed two lawsuits against a mushroom farm and one of its owners, an attorney said on Friday.

According to lawsuits filed on Wednesday, Jose Perez, 38, and his brother Pedro Perez, 24, were employed and residing at the California Terra Garden, Inc. mushroom farm in Half Moon Bay when Jose Perez and six other people were shot and killed by suspected gunman Chunli Zhao. Pedro Perez was also hurt in the shooting, which took place at two different farms.

Zhao has entered a not guilty plea to seven counts of first-degree murder and one count of attempted murder. On January 23, 2023, Zhao is accused of shooting four individuals at California Terra Garden, Inc. and three more at a different farm two miles away.

According to a case filed in San Mateo County Superior Court, the family of Jose Perez is suing the proprietors of California Terra Garden, Inc. and its owner, Xianmin Guan, for wrongful death and survival action. In a different action, Pedro Perez is suing the owners, alleging carelessness.

According to the claims, the proprietors of the farm “failed to adequately secure their premises against reasonably foreseeable criminal acts” in addition to providing “deplorable living conditions.”

During a press appearance on Friday, Pedro Perez stated, “I have suffered a lot,” speaking through a translator. “We are making this demand, this lawsuit, because I spent two months in the hospital.”

The gunshot victim reported that he was wounded once in the arm, once in the face, and once in the stomach. He is still in pain while he recovers.

“I’m still working on improving,” Pedro Perez declared. Since then, I’ve had trouble even standing up, and I’m still not working. In addition, he mentioned that he had lost his brother, to which he added that the two of them “were inseparable.”

Because they reside in Oaxaca, Mexico, the family suing on Jose Perez’s behalf was not present during the press conference.

Attorney Duffy Magilligan stated that they are seeking recompense for the victims, although he did not provide a figure.

In an attempt to get in touch with Xianmin Guan for a response to the complaint, TFD has contacted California Terra Garden, Inc.

“Everyone in the state of California has the right to feel safe in their home, and on January 23, 2023, California Terra Gardens, where Jose and Pedro Perez were living, violated their rights,” stated Magilligan during the press conference.

Both California Terra Garden Inc. and Concord Farms Inc., the locations of the two shootings and Zhao’s place of employment, were cited last June for more than a dozen occupational safety and health violations, including neglecting to address prior instances of workplace violence and lacking a plan or procedure to alert staff members to an active shooter. Zhao is scheduled to appear in court later this month while he awaits trial. TFD has already contacted his lawyer for comment.
