An appeal by the late R&B musician Luther Vandross’s estate has been granted by Madonna.

According to Madonna’s representatives, Entertainment Weekly, the singer has taken out an image of Vandross from her “Live to Tell” tribute performance during her “Celebration Tour.” The performance features a visual montage of artists who passed away from complications related to AIDS, including Keith Haring and Freddy Mercury.

The estate apparently got in touch with Madonna’s tour crew to request a correction after Vandross was featured in the montage during a concert in California earlier this month.

According to a statement provided to Page Six by his estate counsel, Luther Vandross passed suddenly in 2005 as a result of complications from a stroke he had two years prior. “While we respect Madonna’s acknowledgement of the lives lost to AIDS, Luther never received an HIV or AIDS diagnosis.”
