
A disturbing case from Bahraich district in Uttar Pradesh has come to light after a woman accused her father-in-law of repeatedly raping her while threatening her with a firearm. The woman has also alleged that her husband subsequently ended their marriage by pronouncing triple talaq over the phone.
According to police, the woman, WHO is originally from Lucknow and got married in 2023, filed a complaint detailing a series of alleged assaults that took place while her husband was away from home for work.
Woman Alleges Repeated Sexual Assaults
In her complaint, the woman claimed that her father-in-law took advantage of her husband’s absence and sexually assaulted her on multiple occasions. She alleged that he used a country-made pistol to threaten her and prevent her from reporting the incidents.
The woman stated that the most recent alleged assault occurred on January 24. She further claimed that when she tried to raise an alarm and seek help, other members of her husband’s Family did not support her.
According to her allegations, her mother-in-law, sister-in-law, and brother-in-law instead assaulted her after she spoke about the incident.
Husband’s Version Differs
Police said that during questioning, the husband disputed the allegations and claimed that the couple had been experiencing marital problems. He also alleged that his wife was involved in a relationship with another person.
The woman, however, maintains that after she returned to her parental home, her husband contacted her by phone and pronounced instant triple talaq, effectively ending the marriage.
Case Registered Against Five Family Members
Based on the woman’s complaint, police have registered a case against five members of her in-laws’ family:
- Husband
- Father-in-law
- Mother-in-law
- Brother-in-law
- Sister-in-law
The case has been filed under relevant provisions of the Bharatiya Nyaya Sanhita (BNS) as well as the Muslim Women (Protection of Rights on Marriage) Act.
Police Investigation Underway
Rupaideha Station House Officer (SHO) Ramesh Kumar Rawat said authorities are examining both the allegations made by the woman and the counterclaims presented by her husband.
According to police, no arrests have been made so far, and investigators are collecting evidence and statements before taking further action.
“The matter is under investigation. Further action will be taken based on the facts that emerge during the probe,” SHO Ramesh Kumar Rawat said.
Triple Talaq Remains Illegal in India
The case also brings attention to India‘s law on instant triple talaq. In 2019, the Indian government enacted legislation making the practice illegal. Under the Muslim Women (Protection of Rights on Marriage) Act, a Muslim husband who pronounces instant triple talaq can face imprisonment of up to three years along with a fine.
As the investigation continues, police say all allegations will be examined thoroughly before any further legal action is taken.
